Violations and how we are responding

The MPHD's Pest Management staff has sprayed Nashville neighborhoods many times in the last four years:

a. during Air Quality Alerts in neighborhoods that had no diseased mosquitoes

b. without taking less toxic action in problem areas first - most recently in 2006 (click here for details)

c. without following scientific protocol in 2003-2004 and violating their protocol in 2006

d. in neighborhoods with less than 35 mosquitoes in traps and no disease in 2006 (click here for details)

e. while citizens were in plain view of the drivers 2003-2006 (click here for details)

They have jeopardized our health by these actions. In addition, they are contributing to the creation of resistant mosquitoes by some of their actions. The MPHD's trapping records before and after spraying suggest that this may be occurring.

This is the first step in making sure they act responibly: ORDINANCE NO. BL2007-1389 will provide improved notification and basic protection when the Health Department elects to spray pesticides.


The second step is ongoing. We will continue trying to get the Health Department to respond by:
1. continued and constant attempts to negotiate directly with Health Officials
2. two lawsuits in Chancery Court
3. one appeal that is before an administrative law judge right now
4. meeting with the new director of the Health Department when he arrives in July
